Quick Facts about Worker's Compensation insurance in Florida

  • Coverage Requirement In Florida, businesses with four or more employees (full-time or part-time) are required to have worker's compensation insurance. For construction businesses, coverage is required if there is at least one employee.
  • Exemptions Some owners of corporations, sole proprietors, and partners in a business may be exempt from coverage requirements, but construction contractors cannot exempt themselves from coverage.
  • Benefits Provided Worker's compensation in Florida covers medical care, disability benefits, lost wages, and vocational rehabilitation if employees are injured on the job. In the case of a fatality, it also covers death benefits to dependents.
  • Waiting Period There is a seven-day waiting period before injured employees can start receiving lost wage benefits. However, if the injury causes disability for more than 21 days, benefits are retroactive to the first day of lost time.
  • No-Fault System Florida’s worker's compensation system is "no-fault," meaning employees do not have to prove the employer was at fault to receive benefits. In return, employers are typically protected from lawsuits by injured employees.
  • Coverage for Independent Contractors Independent contractors are generally not covered by worker's compensation insurance, unless they are in the construction industry, where special rules apply.
  • Premium Costs Premiums are determined by industry classification, payroll, and claims history. High-risk industries, like construction, generally have higher premiums.

This essential coverage helps cover medical expenses, lost wages, and rehabilitation costs for employees injured on the job. It also provides legal protection for employers by covering potential lawsuits arising from workplace incidents. With worker's compensation insurance, both employers and employees can have peace of mind knowing that they are financially safeguarded against the unexpected.
